A fundamental rights violation petition filed in the Supreme Court by Perpetual Treasuries Private Ltd will be called again on Nov. 2. The petition is being supported to obtain leave to proceed under an allegation of arbitrary treatment by the Governor of the Central Bank, who on July 6, 2017, suspended the Primary dealership of the Perpetual Treasuries Private Ltd. The petitioner wants that decision by the Central Bank nullified by the Supreme Court.
The Court upheld the first preliminary objections by the Attorney General, who said that the petitioner was a company and could not claim violation under Article 14(1)(g), which is only for a citizen.
Deputy Solicitor General Milinda Goonetillake appeared for the Attorney General and the Central Bank, the first respondent.
Gamini Marapana, PC. appeared with Navin Marapana for the Perpetual Treasuries Pvt. Ltd.
The bench comprised Chief Justice Priyasarth Dep, Justice Buwaneka Aluwihare and Justice Nalin Perera.
